These Terms of Service apply to all orders, purchases, and use of the website and services offered under the brand Touché Objects, operated by Studio Hans van Sinderen. By accessing our website or placing an order, you agree to these Terms.

1. Definitions

  • Business / Seller: Studio Hans van Sinderen, operating under the trade name Touché Objects
  • Customer / You: any natural person or legal entity placing an order via our website
  • Products: all items offered for sale via the Touché Objects website
  • Agreement: the purchase agreement between you and Studio Hans van Sinderen

2. Applicability

These Terms apply to all offers, orders, and agreements between Studio Hans van Sinderen (Touché Objects) and the customer, unless explicitly agreed otherwise in writing.

3. Products & Availability

We strive to display our products as accurately as possible.
Please note:

  • Colors may vary due to screen settings
  • Minor variations may occur due to production methods
  • Some products are produced on demand or made to order

Such variations do not constitute a defect.

4. Pricing & Payment

All prices are listed in euros (€) and include VAT unless stated otherwise.
Payment must be completed before an order is processed. The seller reserves the right to refuse or cancel orders in case of pricing errors, suspected fraud, or payment issues.

5. Order Confirmation

An agreement is concluded once you receive an order confirmation email.
The seller reserves the right to cancel orders if products are unavailable or if incorrect information was provided.

6. Delivery

Delivery times are estimates and may vary depending on production and shipping conditions. Delays do not entitle the customer to compensation or cancellation, unless legally required.

7. Right of Withdrawal & Returns

Consumers have the right to withdraw from the agreement within 14 days of receiving the product, in accordance with EU consumer law.

Return conditions, exclusions, and refund procedures are described in our Return & Refund Policy, which forms an integral part of these Terms.

8. Custom & Made-to-Order Products

Products that are custom-made, personalized, or produced in a custom color or finish are excluded from the right of withdrawal, unless defective or damaged upon arrival.

9. Liability

Studio Hans van Sinderen is not liable for indirect damages, including but not limited to consequential loss, loss of profit, or data loss.

Any liability is limited to the purchase price of the product concerned, except where mandatory law provides otherwise.

10. Intellectual Property

All content on this website, including designs, images, texts, and trademarks, is the property of Studio Hans van Sinderen or its licensors.
Reproduction or use without prior written consent is prohibited.

11. Force Majeure

The seller is not liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to strikes, supply chain disruptions, or technical failures.

12. Governing Law & Jurisdiction

These Terms are governed by Dutch law.
Any disputes shall be submitted to the competent court in the Netherlands.

13. Changes to These Terms

The seller reserves the right to modify these Terms at any time. The most recent version will always be available on the website.
